A few days before the opening of a van Gogh exhibition in Paris in 1947, gallery owner Pierre Loeb suggested that Antonin Artaud (1896-1948) write about the painter. Challenging the thesis of alienation, Artaud was determined to show how van Gogh’s exceptional lucidity made lesser minds uncomfortable. Wishing to prevent him from uttering certain "intolerable truths", those who were disturbed by his painting drove him to suicide. Based on the categories and the unusual designations put forward by Artaud inVan Gogh, the Man Suicided by Society, the exhibition will comprise some forty paintings, a selection of van Gogh's drawings and letters, together with graphic works by the poet-illustrator.
After 10 years of renovating, restoring and remodelling, the Rijksmuseum in Amsterdam reopened its doors on Saturday April 13th this year. Around 20,000 visitors were present to see the 80 rooms and 8,000 artworks, including masterpieces by the Dutch masters: ‘The Night Watch’ (Rembrandt van Rijn) and ‘The Milkmaid’ (Johannes Vermeer).
German car maker Volkswagen took legal action based on trademark law and its CTM „Volkswagen“ (registered inter alia for tires and car repair services) against Germany’s biggest tabloid „BILD-Zeitung“ and car services provider „A.T.U. Auto Teile Unger“ - both jointly promoting low-cost car services labelled „VOLKS-INSPETION“ and „VOLKS-REIFEN“ for BILD readers, introducing A.T.U. as „VOLKS-WERKSTATT“.
Whereas the Higher Regional Court rejected Volkswagen’s claim for injunctive relief, the Federal Court saw a likelihood of association between the signs „VOLKS-INSPEKTIONEN“, „VOLKS-REIFEN“ and „VOLKS-WERKSTATT“ on the one hand and „VOLKSWAGEN“ on the other. In particular, the Federal Court pointed out that – keeping in mind the marks outstanding scope of protection due to the reputation of the trademark “VOLKSWAGEN” - even a singular use of the signs at hand constitutes a risk that the relevant trade circles will in fact see an economical connection between Volkswagen and the promotion at hand.
Therefore, although the trade circles concerned will recognize the differences between the signs, a risk remains that customers might in fact turn to A.T.U. seeking Volkswagen’s services assuming an economical or organizational connection. Thus, a likelihood of confusion in the sense of Article 9 Section 2 lit. b) CTMR is given.
Jan Blokland, sponsored by AIPEX, qualified as an age grouper (M 50-54) at the European Championships Ironman Frankfurt (DE) in July this year. In Frankfurt Jan Blokland was on the podium in his age group. At the GoPro Ironman World Championships Jan Blokland performed very well. After the ocean swim he left the water in division rank 31 but after the bike session Jan Blokland came first of the bike in transition area. The cycling shoes were changed for running gear and during the marathon an athlete from Germany and an athlete from Canada unfortunately overtook Jan Blokland. However, AIPEX is very proud on the superb sports performance (third place in age group M 50-54) of the first AIPEX athlete Jan Blokland. On YouTube there is a road movie about his Ironman race.
